1. Scope

These General Terms and Conditions (the “GTC”) govern access to and use of the digital platforms operated by 03 plates-formes Sàrl, Route de Massongex 4, 1880 Bex, Switzerland (the “Provider”), in particular peritia.care, domi.physio and K-life, as well as the subscriptions to those platforms.

Subscribing to any plan constitutes unreserved acceptance of these GTC.

2. Definitions

  • Customer: the natural or legal person who subscribes to a plan.
  • Professional: a healthcare professional verified and listed on a platform.
  • Service: access to the features of the relevant platform, according to the plan subscribed to.
  • Subscription: the right to access the Service for a defined, renewable period.

3. Description of the services

The Provider develops and operates its own digital platforms on a software-as-a-service (SaaS) basis:

  • peritia.care — verification and classification of healthcare professionals’ competencies on the basis of verified supporting documents.
  • domi.physio — a home-physiotherapy practice platform reserved for verified physiotherapists.
  • K-life — community features and booking of leisure spaces.

The Provider supplies software access only. It is not a party to the care services or other services provided by Professionals to their own patients or clients, and receives no remuneration from them.

4. Formation of the contract

The contract is concluded when the Customer selects a subscription plan, accepts these GTC and completes payment. A confirmation is sent by e-mail.

The Customer warrants that the information provided on registration is accurate and undertakes to keep it up to date.

5. Prices and payment

5.1 Prices are stated in Swiss francs (CHF).

5.2 Subscriptions are invoiced in advance for the subscribed period.

5.3 Card payments are processed by Payrexx AG, a Swiss payment service provider. The Provider stores no card data.

5.4 By subscribing to a recurring plan, the Customer authorises the automatic charging of their payment method at each renewal date, until cancellation.

5.5 In the event of non-payment, the Provider may suspend access to the Service after a reminder has remained unanswered for 10 days.

6. Term, renewal and cancellation

6.1 The Subscription is concluded for the period selected at the time of subscription and renews automatically for an identical period.

6.2 The Customer may cancel at any time from their account area or by e-mail to jump@plates-formes.ch. Cancellation takes effect at the end of the current period; amounts already invoiced are not refunded pro rata.

6.3 The Provider may terminate the contract with immediate effect in the event of a serious breach of these GTC, in particular fraudulent use, submission of falsified documents or failure to comply with professional obligations.

7. Withdrawal and refunds

7.1 Swiss law provides no statutory right of withdrawal for contracts concluded online.

7.2 The Provider nevertheless grants consumer Customers a 14-day period from the first subscription to request a full refund, provided the Service has not been used substantially.

7.3 Refund requests are to be sent to jump@plates-formes.ch and are processed within 10 working days.

8. Customer obligations

The Customer undertakes to:

  • use the Service in compliance with Swiss law and these GTC;
  • submit authentic documents in the context of verification procedures;
  • keep their credentials confidential;
  • make no attempt to access other users’ data or to compromise the security of the platform.

9. Availability

The Provider targets 99% availability of the Service on an annual basis, excluding planned maintenance announced in advance. It is not liable for interruptions caused by external factors (hosting provider, network, force majeure).

10. Liability

10.1 The Provider is liable for damage caused by gross negligence or wilful misconduct.

10.2 To the extent permitted by law, any liability for indirect damage, loss of profit, loss of data or consequential damage is excluded.

10.3 The Provider’s liability is in any event limited to the amounts paid by the Customer during the 12 months preceding the event giving rise to the damage.

10.4 The Provider assumes no liability for the quality, lawfulness or performance of the care services delivered by listed Professionals.

11. Data protection

Personal data is processed in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the GDPR, as set out in our Privacy Policy. Health data, where processed, is subject to reinforced security measures and hosted in Switzerland.

Complaints may be addressed to jump@plates-formes.ch. The Provider acknowledges receipt within 5 working days and provides a reasoned reply within 20 working days.

13. Amendments to the GTC

The Provider may amend these GTC. Subscribed Customers are informed by e-mail at least 30 days before the new conditions take effect. Failing cancellation before that date, the new GTC are deemed accepted.

14. Applicable law and jurisdiction

These GTC are governed by Swiss law, excluding its conflict-of-law rules and the Vienna Convention on Contracts for the International Sale of Goods.

The exclusive place of jurisdiction is Bex, Switzerland, subject to any mandatory places of jurisdiction provided by law.
